PrivateBox AI – Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern your purchase and use of the PrivateBox AI appliance (“Product”) and any related software, services, or documentation provided by PrivateBox AI (“we,” “us,” or “our”). By purchasing, installing, or using the Product, you agree to these Terms.

If you do not agree, do not purchase or use the Product.


2. Product Description

PrivateBox AI is an on‑premises AI appliance designed for secure, local inference of supported AI models. The Product includes:

  • Hardware unit

  • Preinstalled system software

  • Local inference runtime

  • Documentation

  • Optional Support & Updates Plan (sold separately)

We may update features, supported models, or system components at any time.


3. Eligibility

You must be at least 18 years old and legally able to enter into contracts to purchase or use the Product.


4. Orders & Payment

All orders must be paid in full at the time of purchase. We reserve the right to refuse or cancel orders for any reason, including suspected fraud or misuse.

Prices are subject to change without notice.


5. Shipping & Delivery

Estimated delivery times are provided at checkout but are not guaranteed. Risk of loss transfers to you upon delivery to the shipping carrier.


6. Use of the Product

You agree to use the Product only for lawful purposes and in compliance with all applicable regulations.

You may not:

  • Reverse engineer, decompile, or disassemble the software

  • Modify internal hardware or firmware

  • Use the Product to violate privacy, security, or data protection laws

  • Deploy unsupported models or workloads that may damage the system

  • Resell the Product without authorization


7. Software License

The software included with PrivateBox AI is licensed, not sold.

You receive a non‑exclusive, non‑transferable license to use the software solely on the provided hardware.

You may not:

  • Copy, distribute, or sublicense the software

  • Install the software on other devices

  • Circumvent security or licensing mechanisms


8. Updates & Improvements

We may release software updates, patches, or model compatibility improvements. Updates may require an active Support & Updates Plan unless otherwise stated.

We are not obligated to provide updates beyond the warranty period.


9. Warranty

Your purchase is governed by the PrivateBox AI Warranty Policy, which includes:

  • 1‑year Limited Hardware Warranty

  • 90‑day Software Warranty

The Warranty Policy is incorporated into these Terms by reference.


10. Returns & Refunds

All sales are final. Returns and refunds are governed by the PrivateBox AI Return & Refund Policy, which is incorporated into these Terms.


11. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability is limited to the purchase price of the Product.

  • We are not liable for any indirect, incidental, or consequential damages, including:

    • Lost revenue

    • Lost data

    • Business interruption

    • Productivity loss

    • Model output errors

This limitation applies even if we have been advised of the possibility of such damages.


12. No Guarantee of AI Output

AI model outputs may be inaccurate, unsafe, or unsuitable for specific purposes. You are solely responsible for reviewing and validating all outputs.

We make no guarantees regarding:

  • Accuracy

  • Safety

  • Reliability

  • Fitness for a particular purpose


13. Privacy & Data Handling

PrivateBox AI processes data locally on your hardware. We do not collect or store your inference data.

Your use of our website and store is governed by our Privacy Policy.


14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from:

  • Your misuse of the Product

  • Your violation of these Terms

  • Your use of AI outputs


15. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Product was purchased, without regard to conflict‑of‑law principles.


16. Changes to Terms

We may update these Terms at any time. Continued use of the Product after changes constitutes acceptance of the updated Terms.
